About these terms

These terms apply to this website and to products sold by Varnish & Thread ("Varnish & Thread", "we", "us").

Acceptance

By buying, downloading or using a Varnish & Thread product, you agree to these terms. If you do not agree, please do not buy, download or use the products.

Purchases and payment

Varnish & Thread products are counted cross-stitch patterns in PDF form. They are digital downloads, sold and delivered through Payhip at https://payhip.com/VarnishAndThread. Nothing is shipped.

Checkout and payment are processed by Payhip and its payment providers. Their terms and policies also apply to your purchase.

License

When you buy a product, Varnish & Thread grants you a limited, non-exclusive, non-transferable, revocable license to use the PDF files for your own personal use.

You may not resell, redistribute, share, sublicense or upload the PDF files, or any part of them, anywhere else, including file-sharing sites, marketplaces and shared drives. We may revoke this license if you breach these terms.

You're welcome to sell or gift items you stitch from the patterns.

Intellectual property

The underlying artworks are in the public domain. The chart designs, keys, layouts, text and images are owned by Varnish & Thread and protected by copyright and other intellectual property laws. Buying a pattern gives you a license to use it, not ownership of any intellectual property.

Informational purposes only

Pattern details such as sizes, stitch counts and floss suggestions are provided for general information. Preview images are digital renders, not photos of finished stitching, and colors can look different on screen and in thread. You are responsible for your own decisions about materials and use.

Patterns are charted from public-domain museum artworks. Varnish & Thread is not affiliated with, or endorsed by, the museums or DMC.

Refunds

Refunds are available within 14 days for a file problem I can't fix, or for a duplicate order. Email [email protected] with your order details.

Refunds are issued through Payhip under its platform rules.

No warranties

To the fullest extent permitted by law, the products and this website are provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Varnish & Thread does not warrant that the products or this website will be error-free or will meet your particular needs.

Limitation of liability

To the fullest extent permitted by law, Varnish & Thread's total liability for any claim relating to a product, this website or these terms is limited to the amount you paid for the product involved.

To the fullest extent permitted by law, Varnish & Thread is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue or data, even if advised that such damages were possible.

Some places do not allow certain warranty exclusions or limits on liability. Where that is the case, these terms apply only to the extent the law allows.

Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Varnish & Thread from any claims, losses, damages and costs, including reasonable legal fees, arising from your misuse of a product or your breach of these terms.

Changes to these terms

We may change these terms at any time. Changes take effect when they are posted on this page, and the "Last updated" date at the top shows when the terms last changed.

Governing law

These terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law rules, except where the consumer protection laws of the place you live require otherwise.

Severability

If any part of these terms is found invalid or unenforceable, that part will be enforced to the extent possible and the rest of these terms will stay in effect.

Entire agreement

These terms, together with the product description and the Payhip terms that apply to your purchase, are the entire agreement between you and Varnish & Thread about the products.

No waiver

If Varnish & Thread does not enforce any part of these terms, that is not a waiver of the right to enforce it later.
